These Terms and Conditions apply when you use and purchase from our website. Please read our terms and conditions carefully before purchasing. 

Kia Ora, thanks for checking out the terms and conditions of hifovape.co.nz (the “site”). By using this site you are agreeing to follow and abide by our terms and conditions and privacy policy. By agreeing to our terms and conditions you agree that you are also an authorised user of the credit or debit card used to make your purchase and that there are sufficient funds to cover the cost of the goods. It is your responsibility to inform us of any changes to these details as soon as possible. This does not affect your statutory rights as a consumer. 

We may revise our Terms and Conditions and Privacy Policy at any time without notice to you. 

TERMS OF SALE

By placing an order you are offering to purchase a product from hifovape.co.nz and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. 

OUR CONTRACT

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card. 

PRICING AND AVAILABILITY

All prices are shown in New Zealand dollars and include GST where applicable. Prices do not include any costs associated with set-up or installation, which shall be your responsibility. Prices may not include delivery and handling charges. We may vary prices on the website at any time without notice to you.  

All prices are as stated on the Website but Hi-Fo LTD reserves the right at any time to revise the price of goods without notice. Hi-Fo LTD will not honor any sales where products have been sold at an incorrect price in error. In this situation customers will be notified and refunded.  

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and let you know we are cancelling the order. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'. 

The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies. 

DISCOUNT CODES AND PROMOTIONS:

Please note that there are certain items for sale that will be excluded from all promotions and discount codes. Sale items and gift vouchers are excluded from promotional discounts.  

R18 PRODUCTS

Hi-Fo Vape Club sells products that are restricted by law to people age 18 and over, i.e., vaping devices and liquids, and products containing nicotine.   

To view these products you, the customer, will be prompted to verify that you are 18 or over. By clicking enter you agree that you are 18 or over and therefore confirming that you are of the age to purchase R18 products, you accept these terms and agree that you have entered into a legal contract that is in relation to these terms. 

At any time Hi-Fo LTD may request to verify your age and ask for further identification details e.g., Driver License, Passport, Kiwi Access Card. If Hi-Fo has good reason to believe a person is under the age of 18 we may at any time cancel and refund the order without notice. An email notification will be sent to the contact address provided once the order has been cancelled. 

We reserve the right to take legal action and seek compensation for any loss or damage we may suffer as a result of a transaction entered into by a minor, from the parent or guardian of a minor who causes an order to be placed.   

SHIPPING & DELIVERY

We have a flat rate of $5 for shipping anywhere within New Zealand. The delivery address must be an address within New Zealand and cannot be a freight forwarding location.  

 Subject to your compliance with these sale terms and our acceptance of your order, we will sell and supply the products known to you as your order. 

You will be required to be available in person to accept all deliveries, and must show legal 18+ identification upon package arrival. 

Products may not be available for your immediate delivery. We will endeavour to deliver your order to the address you nominate in your order within five (5) days of the date you placed your order.  

On receipt of your order, your order will be dispatched to your specified delivery address generally within 5 business days of the date you place your order. We use our best endeavours to deliver your order within any stated timeframes for dispatch, however, we do not warrant that these timeframes will always be met, as many factors may affect these timeframes.  

We cannot accept responsibility for delivery failures or delays by our third-party delivery contractors. Title and risk in the products, such as loss and damage, pass to you when your order is received by the courier company. 

RETURNS 

If for any reason you're not happy with an item you purchased online, you can return it by sending it back to the distribution center or returning it in-store. 

From receipt of your order, you have 14 days to return items with proof of purchase provided they are in sell-able condition and have not been used, opened or tampered with. Hi-Fo will fulfil its obligations in relation to any good under warranty and/or faulty goods under the Consumer Guarantees Act but please be advised that we do not accept returns on purchases made in-store in "change-of-mind" situations.
